Kemin and OmniActive Settle Lawsuit

27 Nov 2009 --- Kemin Foods, L.C. and OmniActive Health Technologies, Ltd. have reached an amicable settlement of their dispute. The parties agree that Kemin's US Patent No. 5,382,714 ("the '714 patent") titled "Process for Isolation, Purification and Recrystallization of Lutein from Saponified Marigold Oleoresin and Uses Thereof" and the reissues of that patent are valid and enforceable. In conjunction with the settlement, OmniActive will promote and sell its newly launched Lutemax 2020 products. The lawsuit pending in federal court in Florida between the parties has been dismissed.
