Kemin wins patent battle with PIVEG
The Mexican company was producing an identical lutein to Kemin’s Brand in Mexico and selling it on the US market.
Dr. Rodney Ausich, president of Kemin Health stated: “We are pleased with the court’s order on the patent issues. We are gratified that the jury and judge have affirmed the integrity of our intellectual property.”
Kemin had previously been involved in a lengthy lawsuit with Cognis Health & Nutrition, which finally reached a conclusion at the end of 2002. The saga related to the marketing and promotional issues for lutein and lutein esters products. The major outcome of the court case for Kemin was that Cognis now specifically have to label their products as lutein esters.
Loureiro said that PIVEG is however the only company that Kemin is taking to court over patent infringement.
